Terms of Use — Playburst

These Terms of Use ("Terms") apply to the Playburst app for iPhone and iPad ("Playburst", "the app"), published by Marjhorie D Mahinay ("we", "us"). By downloading or using Playburst you agree to these Terms and to Apple's Licensed Application End User License Agreement (the "Apple EULA"). If these Terms and the Apple EULA conflict, these Terms apply to the extent the Apple EULA allows.

1. Using Playburst

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Playburst on Apple devices you own or control, for your own non-commercial entertainment. You may not copy, modify, reverse-engineer, resell or distribute the app, or use cheats, bots, modified clients or exploits to gain an unfair advantage or manipulate leaderboards.

2. Virtual items

Playburst includes virtual items such as coins, gems, boosters, chests, stickers and cosmetic items (characters, pets, outfits and themes) ("Virtual Items").

Virtual Items are a limited licence to use content inside the app. They are not your property, have no real-world monetary value, and cannot be exchanged for cash, sold, transferred or traded.
Gems you buy with real money don't expire.
We may change how Virtual Items work, for example to rebalance the game, but we won't take away gems you paid for or cosmetic items you unlocked, except as described in section 8.
Virtual Items are stored on your device and in your iCloud. If you delete the app and its iCloud data, or stop using iCloud, your progress and Virtual Items may be lost and we can't restore them. Your VIP subscription can always be restored through Apple (see "Restore Purchases" in the Shop).

3. Fair play: no gambling

Playburst contains no gambling or casino mechanics. Chests are earned only by playing and are never sold for real money. Their possible contents are shown before you open them. Nothing random is ever sold. The shop only sells items with fixed, visible contents.

4. Purchases

All purchases are made through Apple's App Store and are subject to Apple's terms. Prices are shown in the app in your local currency before you buy. Refund requests are handled by Apple at reportaproblem.apple.com. Gems are delivered to your device as soon as Apple confirms the purchase.

5. Playburst VIP subscription

What you get: 2× coins from every game, +200 bonus coins each day you claim your daily gift, VIP season track rewards, and no ads. Benefits apply while your subscription is active.
Billing: VIP is offered monthly or yearly. Payment is charged to your Apple ID when you confirm the purchase.
Auto-renewal: the subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Managing and cancelling: you can manage or cancel anytime in Settings › [your name] › Subscriptions. Cancelling stops future renewals; you keep VIP until the end of the period you've paid for.
Free trials: if a free trial is offered, any unused part is forfeited when you buy a subscription.
Rewards you claimed while VIP, such as coins, gems and season items, stay yours after VIP ends.

6. Optional rewarded videos

Playburst may offer optional videos you can choose to watch for bonus coins. They never play automatically or in the middle of a game, and VIP members never see them.

7. Game Center

Leaderboards and achievements are provided by Apple's Game Center and are subject to Apple's terms. Scores that look manipulated may be removed.

8. Changes, suspension and ending service

We may update, change or discontinue features of Playburst. If you seriously break these Terms, for example by cheating to manipulate leaderboards, we may restrict your access to online features. If we ever stop offering Playburst, the app you've downloaded can keep working offline, but we may stop updating it.

9. Disclaimers

Playburst is provided "as is" and "as available". Brain games are for entertainment and practice. They are not medical, psychological or educational assessments, and the Brain Score is not a measure of intelligence or health. To the extent the law allows, we disclaim all warranties not stated in these Terms.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of data or Virtual Items, arising from your use of Playburst. Our total liability for any claim is limited to the amount you paid us through the App Store in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that can't be excluded.

11. Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules, except where the consumer laws of your country of residence require otherwise.

12. Changes to these Terms

We may update these Terms from time to time. We'll change the date at the top and, for significant changes, mention them in the app's release notes. If you keep using Playburst after an update, you accept the new Terms.
